Terms of Service

These Terms of Service ("Terms") govern your use of SwiftSiteAU's services. By engaging our services, you agree to these Terms. Please read them carefully.

1. Services

SwiftSiteAU provides website design and development services for Australian small businesses. Services typically include website design, development, launch support, and optional monthly care/hosting plans. Specific deliverables, timelines, and pricing are confirmed before work begins.

2. Payment

Payment for website build packages is required in full (or as otherwise agreed in writing) before development starts. Monthly care plans are billed in advance. All prices are in AUD and include GST where applicable.

3. Ownership

Upon full payment of the website build fee, you own your website content and the finished site as delivered. The underlying template framework and reusable components remain the intellectual property of SwiftSiteAU and are licensed to you for use on your website. You are free to host, migrate, or hand the site to another developer.

4. Delivery

Delivery times depend on your package: Lite and Starter within 48 hours; Professional within 5 business days; Premium within 7 business days — each measured from receiving the content and information required to complete the project. Delays caused by incomplete, late, or incorrect client materials may extend this timeframe. Rush delivery may be available for Professional and Premium packages for an additional fee — ask us when you enquire. SwiftSiteAU is not liable for delays outside our reasonable control.

5. Revisions

Each package includes the revision period described at the time of purchase (typically up to two revision rounds within 14 days of first delivery, unless otherwise stated). Revision requests outside that scope or timeframe may be quoted separately.

6. Money-Back Guarantee

If you are not happy with your website after we have completed up to two included revision rounds, you may request a full refund of the website build fee. To claim the guarantee:

• Email swiftsiteau@gmail.com with a clear refund request.
• Submit the request within 7 days of the second revision being delivered (or within 14 days of first delivery if you choose not to use revisions).
• The refund covers the one-time website build fee only. It does not cover third-party costs such as domain registration, paid stock assets, or advertising spend.
• Monthly care/hosting fees already charged for periods of service used are not refundable. Unused prepaid care periods may be refunded on a pro-rata basis at our discretion.

Once a refund is issued, any licence to use the delivered website materials ends, and you agree not to continue using the refunded deliverables.

7. Care Plans & Hosting

Care plans are optional and billed monthly in advance. You may cancel at any time with notice before the next billing date. On cancellation, we can provide your website files for self-hosting or migration where reasonably practicable.

8. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, SwiftSiteAU's liability is limited to the amount paid for the relevant service. We are not liable for indirect, incidental, or consequential damages arising from use of our services. Nothing in these Terms excludes rights you cannot waive under Australian Consumer Law.

9. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.
